- EXPRESS ASSUMPTION OF RISK: YOU KNOWINGLY, VOLUNTARILY, AND FREELY ASSUME ALL RISKS, KNOWN AND UNKNOWN, ASSOCIATED WITH COMMUNICATING WITH OR MEETING ANY PERSON INTRODUCED VIA THE SERVICES IN REAL LIFE, INCLUDING BUT NOT LIMITED TO RISKS OF BODILY INJURY, ASSAULT, EMOTIONAL DISTRESS, BATTERY, THEFT, FRAUD, PROPERTY DAMAGE, ILLNESS, OR DEATH.

IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF OMNI AI CLUB ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF: (A) ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD), OR (B) THE TOTAL AMOUNT OF INTRODUCTION AND SERVICE FEES ACTUALLY PAID BY YOU TO OMNI AI CLUB IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless Omni AI Club, its parent companies, subsidiaries, affiliates, and their respective directors, officers, employees, founders, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and litigation costs) arising out of or in any way connected with: (a) your use of or access to the Services; (b) your conduct during in-person dates or offline meetings; (c) your breach of any representation, warranty, or covenant in these Terms; (d) your violation of any third-party right (including privacy or intellectual property rights); or (e) any dispute between you and a third-party merchant or venue.
11. mandatory binding individual arbitration & class action waiver
